1. About Eeram Engineering
These Terms and Conditions govern the use of the Eeram Engineering website and, where applicable, the provision of goods and services by Eeram Engineering.
Eeram Engineering is an agricultural engineering and workshop business based in Harrismith, Free State, South Africa. Our services may include agricultural implement manufacturing, structural steelwork, machinery repairs, fabrication, welding, machining and related engineering services.
By using this website, requesting a quotation, or accepting a quotation for goods or services, you acknowledge these Terms and Conditions.
Where a written quotation or other written agreement contains specific terms relating to a particular project, those terms will apply to that project together with these Terms and Conditions.
2. Definitions
For purposes of these Terms and Conditions:
“Eeram Engineering”, “we”, “us” or “our” means Eeram Engineering.
“Client”, “you” or “your” means any person, business or organisation requesting or receiving goods or services from Eeram Engineering.
“Website” means the Eeram Engineering website at eeramengineers.co.za and any associated pages operated by Eeram Engineering.
“Services” means engineering, fabrication, welding, machining, repair, maintenance, structural steelwork and other workshop services provided by Eeram Engineering.
“Goods” means agricultural implements, fabricated components, machinery, steelwork, repaired equipment or other physical items supplied by Eeram Engineering.
“Quotation” means a written quotation issued by Eeram Engineering setting out the proposed goods or services, pricing and applicable project conditions.
“Project” means a specific job, repair, manufacture, fabrication or other engagement undertaken by Eeram Engineering.
3. Use of the Website
The information published on this Website is provided for general information about Eeram Engineering, our capabilities and our services.
We make reasonable efforts to keep the information on the Website accurate and current. However, website information may change and may not contain every technical detail relevant to a particular project.
Descriptions, photographs, examples and other information displayed on the Website do not constitute a quotation, guarantee of availability or binding specification for a particular project.
A specific Project will be governed by the written quotation and any agreed project specifications.
4. Quotations
All work undertaken by Eeram Engineering is subject to a written quotation where appropriate.
A quotation may specify:
- the goods or services to be supplied;
- the estimated cost;
- applicable materials and components;
- estimated completion or delivery time;
- payment requirements;
- exclusions and assumptions; and
- any project-specific conditions.
Unless otherwise stated in writing, a quotation is subject to the availability and cost of materials, components and workshop capacity.
A quotation may need to be revised where inspection, dismantling or further assessment reveals additional work or materials that were not reasonably identifiable when the quotation was prepared.
Any material change to the scope or price of a Project will be discussed with the Client before the additional work is undertaken, where reasonably practicable.
5. Acceptance and Commencement of Work
A Project will commence once the quotation has been accepted and any required deposit or payment has been received.
Eeram Engineering may require an upfront payment for materials, specialised components or other Project costs before work commences.
No work requiring the purchase of materials or commencement of fabrication will be undertaken until the applicable requirements stated in the quotation have been met.
Acceptance of a quotation confirms that the Client has reviewed the scope of work, pricing and applicable conditions.
6. Custom Manufacturing and Fabrication
Custom agricultural implements, fabricated structures and specialised components are manufactured according to the requirements agreed with the Client.
The Client is responsible for providing accurate information relating to the intended use of equipment, including relevant dimensions, operating conditions, loads and other information reasonably required for the Project.
Where a Client supplies drawings, measurements, components or specifications, Eeram Engineering may rely on the information provided unless otherwise agreed.
Changes requested by the Client after work has commenced may affect the Project cost and completion date.
7. Repairs and Existing Machinery
Machinery and equipment presented for repair may contain faults or wear that cannot reasonably be identified before dismantling or inspection.
Where additional faults or required repairs are discovered, Eeram Engineering may provide a revised quotation or request approval for additional work before proceeding.
Eeram Engineering will take reasonable care of Client property while it is in our possession. Clients should remove personal items and other property that is not required for the Project before equipment is delivered to the workshop.
8. Materials and Components
Eeram Engineering will make reasonable efforts to source suitable materials and components for each Project.
Material availability, supplier lead times, discontinued components, price changes and other supply issues may affect Project timelines or pricing.
Where a material or component specified in a quotation becomes unavailable, Eeram Engineering may discuss a suitable alternative with the Client.
9. Payment
Unless otherwise stated on the quotation, all amounts are payable in South African Rand (ZAR).
Payment methods and payment dates will be specified in the applicable quotation or invoice.
Eeram Engineering may suspend work where an agreed payment is overdue.
Any bank details supplied for payment should be verified with Eeram Engineering before making a payment, particularly where banking information appears to have changed.
10. Cancellation and Changes
A Client may request cancellation of a Project before completion.
The consequences of cancellation will depend on the stage of the Project and the costs already incurred.
Where Eeram Engineering has already purchased materials, commissioned specialised components, commenced fabrication or performed work specifically for the Client, the Client may be responsible for reasonable costs already incurred, subject to any rights provided by applicable South African law.
Any refund or cancellation will be dealt with in accordance with the applicable quotation, agreement and legislation.
11. Completion, Collection and Delivery
Eeram Engineering will provide an estimated completion date where reasonably possible.
Completion dates are estimates unless a specific completion date has been expressly agreed in writing.
Completion may be affected by material availability, supplier delays, unforeseen repair requirements, equipment availability, power interruptions, industrial action, weather, transport difficulties or other circumstances beyond our reasonable control.
Unless otherwise agreed, completed goods and repaired machinery will be made available for collection or handover at the Eeram Engineering workshop.
Where the Client arranges transport, the Client is responsible for ensuring that the vehicle, trailer and loading arrangements are suitable for the equipment being collected.
12. Inspection and Handover
The Client should inspect completed work and equipment at handover or collection.
Where appropriate, Eeram Engineering may provide operating, maintenance or other relevant information relating to the completed work.
The Client remains responsible for using machinery and equipment in accordance with applicable operating instructions, safety requirements and any limitations communicated by Eeram Engineering.
13. Warranty and Workmanship
Where Eeram Engineering provides a specific warranty for goods or workmanship, the terms and duration of that warranty will be stated in the applicable quotation, invoice or warranty documentation.
Where no separate warranty period is stated, any rights relating to defective goods or services will be governed by applicable South African law.
Warranty or workmanship claims may not apply where a defect or damage results from circumstances such as:
- misuse or abuse;
- overloading;
- unauthorised modification or repair;
- incorrect operation;
- inadequate maintenance;
- normal wear and tear;
- use outside the intended purpose or specified operating conditions; or
- damage caused after handover.
Nothing in these Terms and Conditions excludes or limits any consumer rights or statutory warranty that cannot lawfully be excluded or limited.
14. Intellectual Property
Unless otherwise agreed in writing, Eeram Engineering retains ownership of its pre-existing designs, drawings, technical methods, know-how, templates and other intellectual property.
Where Eeram Engineering develops a design specifically for a Client Project, the Client’s rights to use that design will be determined by the applicable quotation or written agreement.
Payment for a physical manufactured item does not automatically transfer ownership of Eeram Engineering’s underlying designs, drawings, manufacturing methods or intellectual property.
15. Website Content and Intellectual Property
The content of this Website, including text, photographs, graphics, logos, drawings and other material, belongs to Eeram Engineering or is used with permission.
You may view the Website for personal or legitimate business purposes.
You may not reproduce, modify, distribute, publish or commercially exploit Website content without our prior written permission, except where permitted by law.
16. Website Availability
Eeram Engineering makes reasonable efforts to keep the Website available and functioning.
We do not guarantee that the Website will always be available, uninterrupted, error-free or free from technical problems.
We may update, modify, suspend or discontinue any part of the Website when reasonably necessary.
17. Links to Third-Party Websites
The Website may contain links to third-party websites or services.
Eeram Engineering does not control those websites and is not responsible for their content, availability, security or privacy practices.
Accessing third-party websites is at the user’s own discretion and subject to the terms and policies of those websites.
18. Limitation of Liability
Eeram Engineering will take reasonable care in providing its goods and services.
Nothing in these Terms and Conditions excludes or limits liability where such exclusion or limitation is prohibited by South African law.
To the extent permitted by law, Eeram Engineering will not be responsible for losses that arise from the Client’s misuse, unauthorised modification, incorrect operation, failure to maintain or use of equipment outside its intended purpose or specified operating conditions.
Eeram Engineering will also not be responsible for delays or losses arising from circumstances outside its reasonable control.
This clause does not limit any rights or remedies that a consumer may have under applicable legislation, including the Consumer Protection Act, 68 of 2008.
19. Consumer Protection Act
Where the Consumer Protection Act, 68 of 2008 (“CPA”) applies to a transaction, nothing in these Terms and Conditions is intended to exclude, restrict or waive any right or obligation arising under the CPA where such exclusion, restriction or waiver would be unlawful.
Where the CPA requires a term to be drawn to a consumer’s attention because it limits liability, creates an assumption of risk, imposes an indemnity or constitutes an acknowledgement of fact, Eeram Engineering will take reasonable steps to ensure that the relevant provision is brought to the consumer’s attention as required by law.
If any provision of these Terms and Conditions conflicts with a mandatory provision of applicable consumer-protection legislation, the applicable legislation will prevail.
20. Privacy and Personal Information
Eeram Engineering may collect and process personal information provided through the Website or during the course of providing goods and services.
Personal information may be used for purposes including:
- responding to enquiries;
- preparing quotations;
- communicating with Clients;
- providing goods and services;
- processing payments;
- issuing invoices and maintaining business records; and

21. Complaints
If you have a complaint concerning our goods or services, please contact Eeram Engineering first so that we have an opportunity to investigate and address the matter.
Complaints should include sufficient information to enable us to identify the relevant Project, quotation, invoice or service.
Nothing in this complaints process limits any statutory right available to a consumer.
Where applicable, consumers may also make use of an appropriate recognised dispute-resolution or ombud process.
22. Governing Law
These Terms and Conditions are governed by the laws of the Republic of South Africa.
Any dispute will be dealt with in accordance with applicable South African law and the jurisdiction of the appropriate South African courts.
23. Changes to These Terms and Conditions
Eeram Engineering may update these Terms and Conditions from time to time.
The latest version will be published on the Website with the applicable “Last Updated” date.
Changes to these Website Terms and Conditions will not automatically alter the terms of a Project that has already been accepted and commenced, unless the parties agree otherwise in writing or the change is required by law.
24. Severability
If any provision of these Terms and Conditions is found to be unlawful, invalid or unenforceable, that provision will be dealt with to the extent required by law and the remaining provisions will continue to apply.
25. Entire Agreement
These Terms and Conditions, together with any applicable quotation, invoice, written agreement and other documents expressly incorporated into the relevant Project, constitute the agreement applicable to the relevant goods or services.
Where a Project-specific written agreement conflicts with these Website Terms and Conditions, the Project-specific agreement will apply to that Project to the extent of the conflict.
